Chapter 7 bankruptcy is intended for individuals facing significant financial hardship who cannot afford to repay their debts. Those with primarily consumer debts must undergo a “means test” to determine eligibility. If your income exceeds the median level for your state and household size, creditors may file a motion under § 707(b) of the Bankruptcy Code, requesting that the court dismiss your case. The court will ultimately decide whether the case can proceed.
Under Chapter 7, most assets are exempt, and the majority of filers retain all their belongings. In Chapter 13, you have the option to keep all assets since unsecured debts are typically treated as if they were paid in full. Regardless of the bankruptcy chapter, all assets must be disclosed when filing.
The goal of filing for Chapter 7 is to receive a discharge of qualifying debts. However, if the court finds evidence of misconduct, such as fraud, it may deny the discharge, undermining the purpose of the bankruptcy filing. Seeking proper legal guidance is essential to ensure a successful outcome.

Chapter 7 generally eliminates most unsecured debts, but some obligations remain. These may include certain taxes, student loans, debts incurred to pay non-dischargeable taxes, child support, alimony, criminal fines, penalties, restitution, and obligations from personal injury caused by driving under the influence. Additionally, debts related to fraud, breach of fiduciary duty, theft, or willful and malicious actions may not be discharged if successfully challenged by a creditor.
